1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Promptify.AI (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or guardian has agreed to these Terms on your behalf. Creating multiple accounts to circumvent free tier usage limits is strictly prohibited.

3. Acceptable Use

You agree not to:

• Upload images that contain explicit, pornographic, graphically violent, hateful, or otherwise illegal content. Our automated safety systems will block such uploads.
• Use the Service to generate prompts designed to create content that infringes on third-party intellectual property, privacy, or publicity rights.
• Attempt to reverse engineer, disrupt, overload, or automatically scrape the Service, or bypass established plan usage caps.
• Resell, sublicense, or redistribute access to the Service without our express written permission.

4. Subscriptions and Billing

Paid plans are billed on a recurring monthly or annual basis through Stripe. By subscribing, you authorize us to charge the selected payment method until canceled. You can cancel your subscription at any time from your account settings; cancellation takes effect at the end of your current billing cycle.

5. Refund Policy

All subscription payments are non-refundable except where required by law. If you cancel, you retain access to paid features until the end of your current billing period. 6. AI Outputs & Third-Party Dependencies

Prompts are generated using third-party AI models and vision systems. Outputs may occasionally be inaccurate, incomplete, or unexpected. We do not guarantee specific image generation results when prompts are pasted into external AI tools. Furthermore, we are not responsible for service outages, syntax changes, or model deprecations made by third-party AI providers (such as Midjourney, OpenAI, Google, or Adobe).

7. Intellectual Property & Ownership

• Your Uploads: you retain full ownership of all original images you upload to the Service.
• Generated Prompts: you own all rights, title, and interest in the textual prompt outputs generated for you by the Service, including the right to use them for commercial projects.
• Our Service: we retain all rights, title, and interest in Promptify.AI, including its interface, branding, software, and underlying code. You may not copy or mirror any part of the Service without our written permission.

8. Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Promptify.AI shall not be liable for any indirect, incidental, or consequential damages, or for any loss of data, profits, or third-party AI subscription costs arising from your use of the Service.

9. Termination

We reserve the right to suspend or terminate your account immediately if you violate these Terms or engage in abusive credit farming. You may close your account at any time by contacting us.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
